This week's posts circle one thread: the regulatory scaffolding around AI and connected devices is being built out in real time, from EU AI Act classification to FDA validation of LLM-based devices. The frameworks that were theoretical a year ago now carry concrete compliance expectations.

David Pudwill laid out the validation problem that sits underneath every LLM-enabled submission: a model whose outputs shift with context is hard to pin to the fixed, reproducible evidence FDA review is built on. The challenge is not whether the technology works; it is how you demonstrate it works the same way every time.
For MedTech teams, this is the near-term gating issue on AI device strategy. If your roadmap includes generative or LLM components, the validation approach needs to be scoped early, because it shapes your predicate logic, your test design, and how much of your submission the agency can actually accept.
Dr. Irene Thomas closes her four-part series on intended use with the benefit-risk determination under EU MDR.
Her core point: the benefit-risk profile is a clinical argument specific to your device, patient population, and the current state of the art, and Notified Bodies flag templated justifications as a common deficiency. She walks through it with a total hip replacement example, from residual risks after ISO 14971 controls to the clinical endpoints that show whether benefits outweigh those risks, and notes that Article 61 requires the determination to stay favorable across the device's life as PMS and PMCF data evolve. This week's developments reinforce the move toward digital, data-driven, implementation-focused, and risk-based regulation across Europe, the United Kingdom, Switzerland, Australia, Asia, Brazil, and Egypt.
Organisations should prioritise structured regulatory data, digital regulatory platforms, UDI registration, quality management systems, clinical evidence, post-market surveillance, cybersecurity, AI governance, and privacy compliance.Particular attention goes to clinical investigations, digital regulatory infrastructure, regulatory transparency, data governance, and continuous lifecycle management, as these are becoming baseline expectations across the global regulatory landscape.
On Friday's In Focus, David Filmore broke down the MDUFA VI draft covering FY2028 through FY2032, which Congress must enact before October 1, 2027. Industry fees fund roughly half of CDRH's budget, so this agreement sets what companies pay and what they get for five years. The whole thing is still proposed, and the FDA comment window closes August 5. Watch the replay >>
